FIVE-YEAR LIMITED WARRANTY

Applicable to night vision monoculars, binoculars, goggles, clip-on systems, and weapon sights
Thank you for choosing KJA Night Vision. We build our night vision devices to perform in demanding conditions, and we stand behind them. This Five-Year Limited Warranty (the “Warranty”) describes the coverage KJA Night Vision provides to the original purchaser (“you”) of a covered product.

1. What This Warranty Covers
KJA warrants that each covered product will be free from defects in materials and workmanship under normal use and service for the applicable warranty period set out below, measured from the original date of retail purchase. If a covered defect arises during the warranty period, KJA  will, at its sole option and as your exclusive remedy, repair the product, replace it with a product of equal or comparable functionality (which may be new or refurbished), or refund the original purchase price.

Where a component has a coverage period shorter than five years, that shorter period controls for that component.

2. Image Intensifier Tube Warranty
The image intensifier tube is the heart of an analog night vision device, and KJA warrants it against defects in materials and workmanship for five years. Certain products may have their warranty disclaimed/waived and such products will have it explicitly stated they will not fall under our normal warranty policy.  Because intensifier tubes are sensitive optical-electronic components, the following terms apply specifically to the tube:

•    Cosmetic blemishes, dark spots, or emission points that fall within the manufacturer’s published grading specification for the tube grade you purchased are characteristic of the technology and are not considered defects.

•    A tube is considered defective if it exhibits a loss of function, intermittent operation, or emission  points that are not the result of misuse.

•    Damage caused by exposure to bright light sources beyond the device’s rated tolerance, including direct sunlight, lasers without an approved protective filter, is not covered.

3. What This Warranty Does Not Cover
This Warranty does not apply to damage, defects, or failures caused by:

•    Normal wear and tear, including cosmetic scratches, scuffs, and fading that do not affect performance.

•    Misuse, abuse, accident, dropping, crushing, or operation outside the published environmental, temperature, or waterproof ratings.

•    Liquid intrusion beyond the device’s stated ingress-protection rating, immersion beyond rated depth or duration, or corrosion resulting from such exposure.

•    Unauthorized disassembly, modification, repair, or service by any party not authorized in writing by KJA, including breaking any factory seal.

•    Use of non-approved batteries, power sources, mounts, or accessories that damage the product.

•    Loss, theft, or any product on which the serial number has been altered, defaced, or removed.

•    Improper storage, transport, or failure to follow the instructions in the product user manual.

4. Consumables and Accessories
Batteries, lens covers, desiccant packs, and similar consumable items are provided as-is and are not covered by this Warranty, except where they are demonstrably non-functional at the time of original delivery. Accessories supplied with the product are covered for one year as described in Section 1.

5. Warranty Registration
Registration is not required to receive warranty service.

Retain your dated sales receipt; it is your proof of the warranty start date.

6. How to Obtain Warranty Service
To request service under this Warranty:

•    Contact KJA Customer Support to obtain a Return Merchandise Authorization (RMA) number before sending any product.

•    Provide your name, contact details, serial number, a description of the issue, and a copy of your dated proof of purchase.

•    Pack the product securely in protective packaging and write the RMA number clearly on the outside of the package.

•    Ship the product to the address provided with your RMA. You are responsible for shipping costs to KJA; we will cover return shipping for valid warranty claims within the country of purchase.

Products received without a valid RMA number may be returned to you unserviced. Turnaround time for evaluation and repair is typically 10 to 15 business days after receipt, subject to parts availability.

7. Limitations and Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY KJA MAKES AND REPLACES ALL OTHER EXPRESS WARRANTIES. ANY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIOD STATED ABOVE.

KJA SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR INDIRECT DAMAGES ARISING FROM THE USE OF, OR INABILITY TO USE, THE PRODUCT. KJA’S TOTAL LIABILITY UNDER THIS WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT.

Some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights that vary by jurisdiction.

8. Governing Law and Export
This Warranty is governed by the laws of Texas without regard to its conflict-of-laws principles. Night vision products may be subject to export-control regulations; you are responsible for complying with all applicable laws regarding possession, use, and resale.
